The Sparrow Schools Foundation (referred to as us or we) is a CIO registered with the Charity Commission, Registered Charity No. 1082286. We operate the website www.sparrowschools.org.uk (the Website). These are the Terms and Conditions which govern each use you make of the donation payment services provided through the Website. These Terms and Conditions apply separately to each single donation that you make. Except as provided for in section 6, ‘Regular Donations’, and unless specified by you, they do not form a contract allowing for future or successive transactions to be set up. By confirming on the Website that you wish to make a donation you agree to be bound by these Terms and Conditions for that donation.

1. The Donation Services
We will use your donation at our discretion but within our stated charitable objectives.

All payments through the website are to be made by payment card. We also accept donations by cheque. Cheques can be made payable to The Sparrow Schools Foundation and sent to 42 Alleyn Park, London, SE21 7AA. Please note that we do not accept payment by cash.

Once you confirm to us through the website that you wish to proceed with your donation your transaction will be processed through our payment services provider, Stripe. By confirming that you wish to proceed with your donation you authorise Stripe to request funds from your credit or debit card provider. Stripe will only process your donation in pounds sterling, US dollars, Australian dollars and Euros.

2. Gift Aid
When you donate to us through our website and confirm that you are a UK taxpayer in accordance with the requirements of the Gift Aid scheme as they apply from time to time, we can reclaim Gift Aid. It is your responsibility to ascertain whether you qualify for Gift Aid entitlement. If you have any doubts about your entitlement for Gift Aid we recommend you consult your own advisors or HMRC about any accounting, taxation or financial consequences of making a donation that may affect you. 3. Unauthorised Card Use
If you become aware of fraudulent use of your card, or if it is lost or stolen, you must notify your card provider.

4. Information From You
Before we can process a donation you must provide us with (i) your name, address and email address; and (ii) details of the credit or debit card that you wish to use to fund the donation. We will use this information to process your donation. It is your responsibility to ensure you have provided us with the correct information.

When you submit your payment details, these details will be transferred to our payment provider, Stripe, and your payment data will be collected and processed securely by them. You should make sure that you are aware of Stripe’s terms and conditions, which are different from our own, to ensure that you are comfortable with how they will process your personal data before you make a donation.

We do not share your personal details with any other third party other than is set out in our Privacy Policy. Our Privacy Policy forms part of these Donation Payment Terms and Conditions and by agreeing to these Terms and Conditions you are also agreeing to the way we use and protect your personal information in line with our Privacy and Cookie Policy.

5. Refund Policy
If you make an error in your donation please contact us either by email at info@sparrowschools.org.uk or by post at The Sparrow Schools Foundation, 42 Alleyn Park, London, SE21 7AA within 14 days and a full refund will be made to you.

6. Regular Donations
These Donation Payment Terms and Conditions will only apply to successive donations made through the Website where you have set up a regular donation. When you set up a regular donation you will be scheduling a series of donations to be made on the day of the month that you choose for the period of time you selected or until further notice. You agree that these Terms and Conditions will apply to each of the donations in that series.

By confirming that you wish to proceed with a regular donation you authorise our payment service provider Stripe to request funds from your credit or debit card on the day of each month that you set.

7. General
We reserve the right to amend these Donation Payment Terms and Conditions at any time.

These Donation Payment Terms and Conditions are governed by English law and are subject to the exclusive jurisdiction of the English courts.

DELIVERY
Your order will be delivered to the address you indicated when your order was placed. The products bought on Sparrow Schools Foundation will be delivered to one address in mainland UK or the Isle of Man. We do not deliver to the Channel Islands (Alderney, Guernsey, Jersey and Sark), or to PO Box addresses.

The Sparrow Schools Foundation does everything in its power to respect the delivery times indicated on the website. We cannot, however, be held responsible for the consequences of a late delivery or the loss of a package caused by a third-party contracted to make delivery, or by you, or because of some unforeseen event or an Act of God. In the event where you do not receive your package, an investigation will be conducted with the carrier and may take several days upon receipt of your claim. During this period of investigation, no reimbursement or re-delivery will take place.

RIGHT OF RETURN
The Sparrow Schools Foundation allows you 15 days to return a product that you are not satisfied with. Your right of return starts from the moment your order is delivered. You can return the product to us within this time frame, at your own expense, with your invoice and a completed and signed returns coupon.

We request that you send us the merchandise by registered post and that you purchase insurance with your carrier for the value of the merchandise. This is necessary should they lose or damage the goods. Shipping fees remain the customer’s responsibility. The present right of return only applies to products that are returned in their original, complete condition. Any product that has been damaged, is not in its original packaging, or has packaging that has been worn beyond simply opening the product, will not be refunded. The deadlines mentioned above are effective from the date of receipt of the order.

FOR REIMBURSEMENTS:
If the product is returned within 7 days of its delivery, the User will be reimbursed via the same payment method as was used initially.

PRIVACY AND PROTECTION OF PERSONAL DATA
The details you give us are essential for the processing and delivery of your orders, for billing and for the establishment of warranty contracts, therefore failure to provide these details will result in the cancellation of your order. By registering on the Site, you agree to provide us with sincere and true information as it concerns you. Communicating false information is contrary to the present general Terms and Conditions.

You have the permanent right to access and rectify all the information that concerns you, in accordance with European texts and national laws in place (article 34 of the law of 6 January 1978). You can at any time make a request to Sparrow Schools Foundation to find out what personal information we hold concerning you. You may at any time, and by request, modify this information.

Cookies record certain information stored on your hard drive. This information enables us to generate statistics based on data from visitors to our site and suggest products that might interest you according to the items that you selected when you previously visited the site. Cookies do not contain any confidential information about you.

INTELLECTUAL OWNERSHIP
All the content on The Sparrow Schools Foundation website (illustrations, texts, names, brand names, images and videos) is the property of The Sparrow Schools Foundation. Any partial or total reproduction of this content, by any means and on any support, is subject to prior and express authorisation by Sparrow Schools Foundation. All information, content and files is protected by International law concerning intellectual ownership and copyright. The Sparrow Schools Foundation cannot give you the right to copy, display or distribute content that you do not have the intellectual rights to. All fraudulent use of this content that violates the rights held by a third party constitutes an offence of forgery, which is severely punished under the Intellectual Property Code.

The Sparrow Schools Foundation will not, under any circumstances, be held responsible if a user violates rights held by a third party through his activities on the site.

WAIVER AND SEVERABILITY
Any failure of The Sparrow Schools Foundation to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you and The Sparrow Schools Foundation, and governs your use of the service, superseding any prior agreements (including, but not limited to, any prior versions of the Terms of Service). If any provision of these Terms of Service is held by a court of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Service will continue in full force and effect.

Any opinions left on the website by The Sparrow Schools Foundation customers are screened and moderated by The Sparrow Schools Foundation. If the comments infringe on the law or are inappropriate (abusive publicity, defamation, insults, out of context commentary), The Sparrow Schools Foundation reserves the right to refuse or modify it.
